Who we are

Pastkeep is operated by [registered company name], registered at [registered address]. By creating an account you agree to these terms and to our privacy notice.

What the service is

Pastkeep is a record-keeping tool for working livestock farms. It stores what you enter about your animals, works out figures from it, and produces files you can print or hand to an inspector.

What the service is not

This is the most important section in this document, so it is not buried.

• Pastkeep does not report anything to any authority. It does not notify movements, births or deaths, and it does not file certificates or permits. Making those reports — to the UK services for cattle, sheep and goats, and pigs, or to USDA and your state in the United States — remains entirely your responsibility.
• Pastkeep is not a guarantee of compliance. The statutory rules it encodes — retention periods, standstill windows, the fields on each register — are our reading of current guidance, and some of them are explicitly marked in the app as unverified. Check them against current APHA, DEFRA and VMD guidance in the UK, or USDA APHIS, FDA and your state department of agriculture in the United States, for your species before relying on them.
• Pastkeep is not veterinary or legal advice. Withdrawal dates, treatment records and standstill warnings are arithmetic on what you entered, not professional judgement.

Your account

You are responsible for what happens under your login, so keep your credentials to yourself. You must be old enough to enter a contract where you live, and the information you give us when signing up must be accurate.

Your data is yours

You keep every right you have in the records you enter. We claim no ownership of them and we do not use them for anything except running the service for you. You can export everything at any time from Settings, and you can delete your account and its records from the same place.

You are responsible for the accuracy of what you enter, and for keeping your own copies of records the law requires you to retain.

Acceptable use

• Do not use Pastkeep to break the law or to falsify records.
• Do not attempt to reach another farm's data, or to probe, scan or overload the service.
• Do not resell or redistribute the service without our written agreement.

Availability

We work to keep Pastkeep running, but we do not promise it will be available without interruption. Maintenance, supplier outages and faults happen. Weigh-day recording is designed to keep working without a signal and to sync when one returns, but that is a best effort, not a warranty.

Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Beyond that, and to the extent the law allows, we are not liable for lost profits, lost livestock, penalties, or losses arising from reports you did not make or records that were incomplete or inaccurate. Our total liability in any twelve-month period is limited to the amount you paid us in that period.

Ending the agreement

You can stop using Pastkeep and delete your account whenever you like. We may suspend or end an account that breaches these terms, and where it is reasonable to do so we will tell you first and give you a chance to export your records.

Changes to these terms

We may update these terms. If a change materially affects you we will tell you in the app before it takes effect. Continuing to use Pastkeep after that means you accept the new terms.

Law

If your farm is in the United Kingdom, these terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

If your operation is in the United States, these terms are governed by the law of [state], without regard to its conflict-of-law rules.
